By accessing or using BrandDNA ("the Service"), operated at constructcli.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

BrandDNA is an AI-powered competitive intelligence platform that helps brands analyze their market positioning, track competitor advertising activity, and generate data-driven insights. The Service integrates with third-party platforms including Shopify and Meta to provide analytics and reporting.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to scrape, collect, or harvest data in violation of third-party terms
• Resell or redistribute the Service without our written consent

5. Third-Party Integrations

The Service connects to third-party platforms (Shopify, Meta, etc.) through their official APIs. Your use of these integrations is subject to the respective platform's terms of service. We are not responsible for changes to third-party APIs or services that may affect the functionality of our integrations. You grant us permission to access your data on these platforms solely for the purpose of providing the Service.

6. Shopify App Terms

If you install the BrandDNA Shopify app, the following additional terms apply: The app accesses your Shopify store data to provide competitive intelligence features. You can disconnect the app at any time through your BrandDNA account or by uninstalling it from your Shopify admin. Upon uninstallation, we will delete all Shopify-related data as required by Shopify's platform policies.

7. Intellectual Property

The Service, including its design, features, and content, is owned by BrandDNA and protected by intellectual property laws. AI-generated insights and analysis produced by the Service based on your data are licensed to you for your internal business use. You retain all rights to your original data.

8. Subscription and Billing

Paid plans are billed on a recurring basis through Stripe. You may cancel your subscription at any time through your account settings or the Stripe customer portal. Refunds are handled on a case-by-case basis. The BrandDNA Shopify app is provided free of charge as a data connector to the BrandDNA platform.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. BrandDNA shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately and we will delete your data in accordance with our Privacy Policy.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
